1. General Provisions
1.1 This policy, concerning our processing of personal data, hereinafter referred to as the “Privacy Policy”, describes how THESTUDIO Aarhus ApS collects and processes information about you.
1.2 This Privacy Policy applies solely to private customers.
1.3 However, the Privacy Policy shall also apply to business customers to the extent that we process personal data in that connection.
1.4 This Privacy Policy applies to all personal data you provide to us, or which we collect via our website, www.thestudioaarhus.dk, hereinafter referred to as the “Website”.
1.5 THESTUDIO Aarhus ApS is the data controller for the personal data we collect about you. All enquiries must be made using the supplementary contact details provided under section 8.
2. Collection of Personal Data
2.1 What personal data do we collect?
2.1.1 When you visit our Website, we automatically collect information about you, such as the browser you use, the pages you visit, and information about your device – subject to your consent to cookies.
2.1.2 When you purchase a product on our Website, we also register the following personal data: name, address, e-mail address, telephone number, IP address, as well as information about which products you purchase and potentially return.
2.1.3 When you visit our Website and purchase a product, we collect data regarding your purchase history, as well as data about your behaviour on our Website, for the purposes of online marketing and targeted marketing via our newsletters.
2.1.4 When you complete a contact form on our Website, we also register the following personal data: name, e-mail address, telephone number, IP address.
2.2 For what purposes are the personal data used?
2.2.1 The personal data listed under 2.1.1 are used to improve the purchasing experience and the Website, to optimise conversion, and to conduct targeted marketing.
2.2.2 The personal data listed under 2.1.2 are used to enable us to deliver purchased products to you, to fulfil our warranty obligations, and to comply with our statutory bookkeeping obligations.
2.2.3 If you have consented to receiving newsletters, we use the personal data listed under 2.1.3 and 2.1.4 to conduct online marketing and targeted marketing in the form of personalised newsletters, based on your purchase history and Website behaviour.
2.3 What is the legal basis for processing?
2.3.1 The collection of personal data, as mentioned under 2.1.1, is necessary for us to pursue our legitimate interest in improving the Website, as well as for offering you relevant offers.
2.3.2 The collection of personal data, as mentioned under 2.1.2, is necessary for us to perform the purchase agreement entered into with you. IP addresses are collected in order to prevent fraud.
2.4 Where are your personal data stored?
2.4.1 Personal data are securely stored by third parties, acting as data processors. Some personal data may be disclosed to third parties. Certain of these third parties act as data processors, storing and processing personal data on behalf of THESTUDIO Aarhus ApS in accordance with this Privacy Policy and the respective data processing agreements. All personal data are stored and processed in compliance with applicable data protection legislation.
2.5 How are your personal data collected?
2.5.1 Personal data are primarily collected when completing contact forms, creating customer accounts, and completing purchases.
2.5.2 In addition, personal data are collected via the Website, including through the use of cookies (see section 7 of this Privacy Policy).
2.5.3 THESTUDIO Aarhus ApS does not receive personal data about you from other companies except where this follows from data portability at your request.
3. Use of Data Processors and Data Controllers
3.1 We make use of external companies to assist with the technical operation of the Website and to carry out targeted marketing, including retargeting, assessment of purchase flows, and improvements to the Website. Some of these external companies act as independent data controllers for the data disclosed to them. The legal basis for such disclosure is a balancing of interests between THESTUDIO Aarhus ApS and the user. This means that personal data will not be disclosed where the customer’s interests override those of THESTUDIO Aarhus ApS. In addition, THESTUDIO Aarhus ApS has entered into agreements regarding the disclosure of data to external companies for the purpose of fulfilling contracts, e.g. PostNord for delivery or DBK for dropshipment arrangements.
3.2 Other external companies act as data processors under our instruction. They process data on our behalf, and THESTUDIO Aarhus ApS is therefore responsible for ensuring that such data processors do not use data provided by us for purposes other than fulfilling the agreement entered into with us.
3.3 One of these data processors, Google Analytics by Google Inc., is established in the USA, and the necessary safeguards for transferring information to the USA are ensured through the processor’s certification under the EU–U.S. Privacy Shield. A copy of the certification can be found here.

3.4 In order to improve the purchasing process, the e-mail address provided will be used to send a separate request to review THESTUDIO Aarhus ApS and the courier service used.
4. Your Rights
4.1 We seek, to the fullest extent possible, to ensure transparency regarding our processing of your personal data, and in this context, we as the data controller must inform you of your rights.
4.2 Documentation
4.2.1 As part of our efforts to strengthen the overall level of data security, we require documentation before processing a request in which you exercise the rights listed in sections 4.3–4.9.
4.2.2 When contacting THESTUDIO Aarhus ApS regarding deletion of personal data, you must undergo an identification process before the personal data are erased. This entails that you will be sent a PDF, which you must sign personally and return either in physical form or as a scanned document.

4.2.3 Where the request concerns other rights as listed below, it will be sufficient to send a request from the registered e-mail address. Such requests should be sent to info@thestudioaarhus.dk. If the originally associated e-mail address is no longer in your possession, the documentation requirement under section 4.2.2 shall apply.
4.3 Right of Access
4.3.1 You are entitled at any time to request information on which personal data we have registered about you, the purpose of the processing, and which data processors we use in connection with the processing.
4.3.2 This right may be exercised by generating an automatic report. This can be requested by contacting THESTUDIO Aarhus ApS, which will then send an e-mail containing your personal data to you.
4.4 Right to Rectification
4.4.1 You are entitled to have inaccurate personal data about yourself corrected by us. Should you become aware of any errors in the data we have registered about you, you are encouraged to contact us in writing so that the information can be corrected.
4.4.2 Information collected in connection with the creation of your customer account may be corrected by you directly by logging into your customer account under “Log in”.

4.5 Right to Erasure
4.5.1 In certain cases, you are entitled to have your personal data erased by us. To the extent that the data are necessary, for example, for us to comply with our bookkeeping obligations, we are not obliged to erase your personal data. The same applies if the data are required to establish or defend a legal claim.
4.5.2 If you wish to exercise your right to erasure, please send an e-mail to info@thestudioaarhus.dk, stating your name and membership number. Where necessary, we may request that you provide additional information or documentation. Please refer to section 4.2 regarding documentation.

4.6 Right to Restrict Processing to Storage
4.6.1 In certain cases, you are entitled to request that the processing of your personal data be restricted to storage only, for example if you believe that the data we process about you are not correct.
4.7 Right to Data Portability
4.7.1 You are entitled to receive your personal data in a structured, commonly used, and machine-readable format and have the right to transmit those data to another data controller when we collect your personal data in connection with your purchase of a product from us.

4.8 Right to Object
4.8.1 You may at any time object to our processing of your personal data that we collect for the purpose of improving functions on the Website and its design, if you have specific reasons relating to your situation.
4.8.2 If we are unable to demonstrate legitimate grounds for continuing the processing, we will no longer be entitled to process your personal data.

4.9 Right to Withdraw Consent
4.9.1 You are entitled at any time to withdraw your consent regarding your subscription to our newsletter.

4.10 Right to Lodge a Complaint
4.10.1 You are entitled at any time to lodge a complaint with the Danish Data Protection Agency (Datatilsynet), Carl Jacobsens Vej 35, 2500 Valby, regarding our processing of your personal data.
5. Deletion of Personal Data
5.1 Personal data registered about you via our Website will generally be stored for 5 years, provided there is no activity on the account. Activity means making a purchase, changing information, or logging in. The customer account will therefore only be deleted if it has been inactive for 5 years.
5.2 All invoices are stored for 5 years from the end of the financial year in accordance with the Danish Bookkeeping Act. After 5 years, all invoices are anonymised.
5.3 All purchase information is automatically deleted after 5 years.
5.4 Data collected in connection with your consent to receive newsletters will be deleted if you withdraw your consent, see section 4.9.
6. Data Security
6.1 We have implemented appropriate technical and organisational security measures to prevent personal data from being accidentally or unlawfully destroyed, lost, altered, or impaired, and to prevent unauthorised access or misuse.
6.2 As part of the implementation of organisational security measures, we have established guidelines for which employees have access to your data, ensuring that only employees with a legitimate need may access your data.
7. Cookies
7.1 What is a cookie?
A cookie is a small data file stored on your computer, tablet, or mobile phone. A cookie is not a programme and cannot contain harmful software or viruses.
7.2 Use of cookies on the Website
Cookies are necessary for the Website to function. Cookies also help us gain an overview of your visit to the Website, so we can continuously optimise and adapt the Website to your needs and interests.
